Chapter 6.04 ANIMAL CARE AND CONTROL REGULATIONS
6.04.140 Sale of impounded livestock.
A. If the owner of any impounded livestock fails to redeem the animal
within three days of impoundment, or if animal and environmental control cannot
identify the owner, the animal shall be sold at public sale at a time and place
named in a notice of sale or disposed of in accordance with policies established
by the director of animal and environmental control. The date of sale shall not
be less than ten days from the date of the posting of such notice.
B. If
any animal sold pursuant to this section is sold for more than is sufficient to
pay the fines, fees, and charges aforesaid, such excess shall be deposited with
animal care and control in accordance with the budget ordinance in the donation
account. If the owner of the animal sold provides claim and evidence or
affidavit of ownership within six months from the date of the sale, the excess
shall be paid to the owner. If after six months, such excess is not claimed, the
excess fees shall be available for use by animal care and control. (Ord. 07-O-23
