Chapter 11.08 ROAD USER FEES
11.08.060 Penalty for nonpayment.
A. If the road user fee is not paid after the expiration of
sixty (60) days from the due date of the user fee, the fees may be enforced by
judgment and attachment or such other means provided for under the laws of the
state of South Carolina. Nothing in this section shall be construed as a limit
on the time for the bringing of an action to collect such fees. In addition to
the fee provided herein, the county may recover reasonable attorney’s fees
and other expenses of litigation or collection. Action under this section shall
apply to the road user fee applied to separate vehicles.
B. Criminal Penalties. In the event an individual does not
pay the assessed road user fee on any vehicle, upon which the fee is assessed,
within sixty (60) days of the last day of the month in which the road user fee
is due, the defaulting vehicle owner may be fined twenty-five dollars ($25.00)
per unpaid vehicle and/or sentenced to twenty-four (24) hours in jail per
offense.
Process for failure to pay the road user fee shall be by
uniform ordinance summons and tried in Magistrate’s Court. (Ord. 93-O-25
