13.04.010 Adoption by reference.

A. The following codes are adopted by reference as though they were copied herein fully:

International Building Code—2003 Edition including Chapter 1;

International Energy Conservation Code—2003 Edition;

International Fire Code—2003 Edition;

International Fuel Gas Code—2003 Edition;

International Mechanical Code—2003 Edition;

International Plumbing Code—2003 Edition;

International Residential Code—2003 Edition including Chapter 1 and Appendix G—Swimming Pools, Spas, and Hut Tubs;

National Electrical Code—2002 Edition including Appendix G;

NFPA 101 Life Safety Code—1997 Edition;

SSTD 10-99 as a reference standard for hurricane resistant residential construction;

Standard Amusement Device Code—1997 Edition.

B. Within said codes, when reference is made to the duties of a certain official named therein, that designated official of Colleton County, who has duties corresponding to those of the named official in said code, shall be deemed to be the responsible official insofar as enforcing the provisions of said code are concerned.

C. Areas Not Affected. This chapter shall not affect any incorporated areas of the county of Colleton nor any parcel of land owned by the state of South Carolina or the federal government, or any buildings or installations placed thereon.

D. Areas Affected. Except for those portions of land excluded under subsection C above, this chapter shall cover all unincorporated portions of Colleton County.

E. Contractor’s Licenses Required. Every contractor or builder who shall make contracts for the erection or construction or repair of buildings for which a county permit is required, and every contractor or builder making such contracts and subletting the same or any part thereof, shall be required to secure a license from Colleton County as provided hereinafter.

F. Application for License. Anyone desiring to be licensed with Colleton County as a general, residential, or mechanical contractor must file an application with the planning department. Such application shall be accompanied by the then current license fee as established by county council. A license shall be issued to any person who shall file such written application and show proof of licensure by the state of South Carolina as a general, residential, or mechanical contractor as applicable.

G. Building Code Fees. Fees as established and updated periodically by county council, usually in the annual budget ordinance, shall apply as set forth in such ordinance.

H. Violation of the construction codes as adopted by Colleton County is punishable by a five hundred dollar ($500.00) fine and/or up to thirty (30) days in jail.

I. Each day’s violation of any provision of the construction code shall constitute a separate offense.
